Privacy Policy for Users of Appgree

The Appgree Platform (hereinafter the “Platform” or “Appgree”) developed by Appgree, S.A. (hereinafter the “COMPANY“) is administered by individuals and firms (hereinafter “Hosts”) to communicate with employees, partners, customers and other users (hereinafter “Users” or “You”) In this case, the Host will be the natural or legal person that has invited you to participate in the platform. We recommend you to check the Host data and its privacy policies before accessing the platform.

This Privacy Policy refers to the ways in which the Host collects, processes and uses your personal information as a consequence of the access to or utilization of the Platform. However, the Host may have other applicable privacy policies so we recommend you to read them before accessing and participating in the platform.

By accessing or using the Platform, you accept and authorize the collection, processing and transmission of your personal data by the Host subject to the terms of this Privacy Policy.

About Appgree

The Appgree platform is an application developed by the COMPANY, which is used by the Host to send questions to members of a community or group of Users, whatever its size, and to collect their responses and rankings in order to establish the most widely supported proposals in record time using an innovative new algorithm (DemoRank).

Users can access Appgree through an application that can be downloaded on your mobile devices and/or through its website version which can be accessed from any compatible browser. In some cases, Users can also access Appgree through the website or mobile app of the Host. This third option is possible thanks to the fact that Appgree offers the possibility to any Host of integrating Appgree contents into its websites or mobile apps through the Appgree Widget or SDK.

The COMPANY as Data Processor

The COMPANY acts as a data processor on behalf of the Host, so the information provided by you through our platform will be treated by the Host under its responsibility and in accordance with its privacy policies. We recommend you to check with the Host the specific privacy policy that will apply to your data obtained through your participation in our platform.

Under no circumstances are we responsible for the data processing carried out by the Host.

What information will the Host receive

Hereafter, we inform you about the type of information that the Host can process through our platform and the possible purposes. It shall be the responsibility of the Host to have you previously informed of any processing of your data other than those listed below, and to have obtained your express consent if necessary.

Regardless of whether the Host has informed you of the processing of your data by its own means and obtained your consent – or has another legitimacy base – the Host generally receives different types of information from You:

  • Contact information: The Host may receive certain contact details when you register and/or use Appgree. Such contact data may include, inter alia, full name, e-mail address, gender and profile photos. All fields marked as obligatory in any form must be completed. The omission of any field may prevent registration or use of the Platform .
  • User Contents: The Host receives information from you each time you participate in an Appgree channel (for example, when your answer a question, consult certain issues, send a photo, etc.).
  • Likewise, the Host receives information about you each time you click, consult or otherwise interact with the Platform, or utilize the Appgree app for mobile devices.

The Host also receives other kinds of information about Users:

  • The Host may obtain information about you if other Users share information about you. However, in such cases, the Users maintain control over how they share the data, which is beyond the Host’s control.

When you access Appgree through another platform (a website or mobile app external to Appgree) through the Widget or SDK that the CLIENT has integrated, the data that the Host receives from you will be those previously mentioned, provided that the Host has previously given you access to Appgree through your email or You have completed the registration process. In those cases in which you have been able to access and participate in Appgree integrated in an external platform without a registration process in Appgree or without prior invitation to Appgree, the following points shall apply:

  • If the website or mobile app of the Host in which Appgree is integrated does not require authentication, your participation will be anonymous and the Host will not receive from you any personal data that can identify you, except for the possible answers that you send to the questions of Appgree.
  • If, instead, the website or mobile app of the Host in which Appgree is integrated does require your identification to access, the Host may relate Appgree data with those of its website or mobile app, and there might be personal data as a result of that relationship.
  • The client or developer has the obligation to inform Users of their website or mobile app that they access Appgree content, a way for them to know and accept this Privacy Policy, the Host being responsible for personal data of Users.

The storage periods for these data depends on the Host, so we must be consult the Host.

The basis for legitimacy of this processing also depends on the Host, since in many cases they will respond to a legitimate interest of the Host, while in others it will depend on the consent given through the acceptance of this privacy policy or the acceptance of the policies of specific privacy that the Host has previously provided.

How does the Host use the information received

The Host uses the data received about Users to provide access to the Platform and allow them to participate in Appgree, and to ensure optimum functioning of Appgree. For example, the Host might use data received about you:

  • for segmentation purposes, allowing personalization of access and use of Appgree.
  • for internal operations, including resolution of problems, data analysis, research, development and improvement of the service.
  • to send, or allow the Host to send, notices related with the use and functioning of the Appgree platform.
  • to protect the Host’s rights and property.
  • to perform statistical segmentation and profiling, which will be under the responsibility of the Host.

The Host may also utilize statistical, analytic and other aggregate data obtained as a result of use of the Platform made by Users (“Use Data”) to improve and personalize the Platform, and to offer other products. Use Data may be freely used by the Host provided that they are previously disassociated and anonymized in an irreversible manner, in accordance with the provisions of the applicable data protection legislation.

In the event that the Host wishes to use the data for different purposes or if these data require an express consent for its processing, the Host must obtain the consent and offer the appropriate prior information. You may require the Host to provide you additional information about its data protection policy.

Who has access to your data

Part of the information which the Host receives about you may become known to the rest of Users of the channel in which you participate. For example, some information will exist which is accessible by Users of the same channel (such as their names and family names, and the photographs included in profiles). Under no circumstances will other confidential profile information be made public apart from your full name and your profile photograph. At all times, your profile (your full name and profile photo) may be seen by other users, without prejudice to the fact that the application may offer mechanisms to control this visibility in future versions.

Other information which you decide to share in Appgree, such as content published in a channel, will be accessible by all Users of that channel by default. However, when an open question is set up in such a way that all responses remain anonymous, neither Users nor the Host will be able to learn the identity of the responders under any circumstances.

The Host can, however, obtain information on the vote cast by every User on the responses of other Users when said Users participate in an open question, and can also obtain information on votes cast by Users to closed questions (known as “polls”), with the aim of carrying out statistical analyses concerning the sources of the votes. The Host may only access this information once the question has finished.

The Host transmits the information on Users to service providers and partners to help them provide, learn about and improve the services offered. For example, the Host may use external providers like the COMPANY to help it host, manage, administer, maintain and resolve incidents related with the Platform, and to analyse data and provide search results. In any case, the Host’s service providers must undertake to use data in conformity with the contract entered into with the Host.

Apart from the cases mentioned above, the Host is expressly prohibited to assign or communicate said information to any third party without your prior permission.

The Host also stores data for the period necessary to provide you with the services described above See the section “Elimination and deactivation of your account” in Conditions of Use for further information on storage of your data after deactivation of your account.

Data Sub-processors

The provision of the services offered by us requires the outsourcing of hosting services and other technological issues. Specifically, the technological services of storage, hosting of servers and processing are arranged with the following companies (hereinafter, Data Processors):

  • Qualoom Expertise Technology, S.L., a Spanish company with Tax Id. No. B85437531 and Registerd Office at Plaza de Valencia 6 Bajo Local, 28937, Móstoles, Madrid.
  • Cloudinary, Inc. 111 W Evelyn Ave Suite 206. Sunnyvale, California. 94086.
  • Amazon Web Services, Inc. (Amazon.com, Inc.), 2021 Seventh Ave, Seattle, Washington 98121.

The data processing performed by Data Processors is regulated by Contract by which they undertake to process the data in a secure manner and respecting data protection.

Notwithstanding the foregoing, you know and accept that we can replace those Data Processors by other service providers, ensuring that the new provider will also respect the privacy, and the relationship will remain regulated by contract.

Both companies, Cloudinary, Inc. and Amazon Web Services, Inc., are subscribed to the Privacy Shield Agreement, so they have a commitment to data protection, and we have their commitment so that the data shall not be stored outside the European Union.

Legal minors

The Appgree platform is intended exclusively for users above 14 years of age, and if you are younger than 14 you are expressly prohibited from registering in and using the platform. For this reason, no system of parental authorization has been established to allow access to persons below the age of 14 years, and by registering in the Platform you represent and warrant that you are above the mentioned age.

The Host reserves the right to request that you provide certain information (e.g. a copy of your ID card) to allow verification of the User’s age, or to delete or deactivate the account of any User who is below the aforementioned age or who fails to provide the documentation requested in the periods established.

Your data on mobile devices

When Users share information, for example by sending messages containing photographs or videos, other Users can synchronize the data using their cell phones, or they can access the data using other devices. For example, if you send a photo in Appgree, anyone who sees it can save it using the Appgree tools or other device or browser functionalities.

Google Analytics

We use Google Analytics, without the possibility of identifying Users, in order to account for the most visited screens, the total time spent visiting the contents of the service and the behaviour flows of Users, as well as the possible errors in the service in order to improve it.

We use the services of Google Analytics for this purpose – and no other purpose – so that at no time is Users performing actions are identified, keeping their identity anonymous, without the possibility of deducting it.

Exercise of rights

Users have the right to revoke at any time the consents previously given in connection with the processing of their personal data and to exercise their rights of access, rectification, erasure, restriction, data portability, and object to the processing of their data, as well as to revoke their consent in the terms provided by law, notifying it to the Host. For these purposes and without prejudice to the possibility of accessing most of your personal data and correcting them by logging into your account and consulting your profile, you may also exercise the aforementioned rights by means of a written request addressed to the Host. Your request must be accompanied by a copy of your National Identity Card or other document proving your identity.

You may file a claim to the control authority at any time.

Response to legal injunctions

The Host may access, store or share your data in response to a legal injunction (e.g. a court order, decision or citation), if it believes in good faith that it is obliged to do so. The Host may also consult, process and store data received about you for prolonged periods of time, when said data are subject to any court injunction or instruction, or in the case of official investigations.

The COMPANY Liability Disclaimer

The COMPANY shall in no case be liable for the processing carried out by the Host for purposes other than those set forth in this Privacy Policy or any breach of the data protection regulations. The COMPANY acts only as developer of the technology and Data Processing Controller for its effective functioning, but does not carry out any data processing on behalf of the Host beyond the retention, storage and maintenance of the platform database.

Any claim or query must be addressed to the Host.

Amendments

  1. The evolution of the services offered via the Platform may require changes to this Privacy Policy. Should the Host make any such changes, notice will be published via its website, including messages posted on the Platform or sent by e-mail, depending on the circumstances.
  2. If such changes are substantial, the Host will seek your express acceptance or will allow a certain period for you to express opposition to the new conditions, on the understanding that the proposed change is tacitly accepted after that period has elapsed.
